Peters Reversed! In
a stunning victory for lenders and servicers, the United States Court of
Appeals for The Ninth Circuit today overturned the Bankruptcy Appellate's
Panel Ruling in the Peters case and held that there is absolutely no cure
upon confirmation of a Chapter 13 Plan, that the Debtor continues to be in
default until all of the arrearages are paid and that
postponements of a foreclosure sale during pendency
of a bankruptcy, including after confirmation of a Chapter 13 Plan, are not
a violation of the automatic stay. For the court's full
opinion, click here.
